Section 8.2 - Waiver of road test

In addition to any other tests required, an applicant for a license, other than a renewal license, shall be required to pass a road test in a vehicle appropriate to the type of license for which application is made, except that such road test requirement shall be waived:

(a) if the applicant was formerly a resident of another state, the District of Columbia, Guam, Puerto Rico, the Canal Zone or a province of Canada and has become a resident of this State, and is or was, within two years prior to the date of application for a New York license, the holder of a valid license issued by the motor vehicle authority of his former residence; or
(b) if the applicant is applying for an original license after revocation of a prior New York license, provided that application is made within two years from the date subject was last validly licensed in this State; or
(c) if the applicant is applying for a commercial drivers license and such applicant demonstrates that s/he meets the requirements set forth in 49 CFR 383.77, in relation to drivers with military experience in the operation of a representative commercial motor vehicle;
(d) incorporation of certain Federal regulations by reference. The provisions of the Code of Federal Regulations which have been incorporated by reference in this Part have been filed in the Office of the Secretary of State of the State of New York, the publications so filed being the booklets entitled Code of Federal Regulations, title 49, parts 383.3, 383.51 383.77, and 383.113, published by the Office of the Federal Register, National Archives and Records Administration. The regulations incorporated by reference may be examined at the Office of the Department of State, One Commerce Plaza, 99 Washington Avenue, Albany, NY 12231, at the New York State Supreme Court Law Libraries, the Legislative Library, the New York State Department of Motor Vehicles, Office of Counsel, 6 Empire State Plaza, Albany, NY 12228. They may also be purchased from the Superintendent of Documents, Government Printing Office, Washington, DC 20402. Copies of the Code of Federal Regulations are also available at many public libraries and bar association libraries.
