Section 10A:72-13.4 - Case review; decision
(a) No earlier than 30 days prior to the parolee's anticipated amended parole supervision termination date, the assigned parole officer shall review the parolee's case with the District Parole Supervisor or designee. The review shall be comprehensive and shall include any instances of non-compliance with all general and special conditions of parole supervision, any other significant supervision-related issues and a determination that the parolee has satisfied all monetary obligations as required pursuant to N.J.S.A. 30:4-123.6 6.
(b) Upon completion of the review required pursuant to (a) above, all appropriate documentation relating to the parolee and the parolee contract agreement shall be submitted to the Supervising Parole Officer.
(c) Upon receipt of the appropriate documentation, the Supervising Parole Officer shall immediately refer the matter to the designated Board panel.
(d) The designated Board panel shall review the parolee's case within five business days and shall determine whether the parolee has complied with the specified components of the parolee contract agreement and the provisions of N.J.S.A. 30:4-123.6 6.
(e) If it is determined by the designated Board panel that the parolee has complied with the provisions of the parolee contract agreement and the provisions of N.J.S.A. 30:4-123.6 6, supervision of the parolee shall be discontinued on the amended parole supervision termination date.
(f) Notice of the determination of the Board panel granting the early termination of parole supervision shall be provided to the Department of Corrections and to the District Parole Office. Upon receipt of the notice, the District Parole Supervisor, designee, or assigned parole officer shall provide a copy of the notice to the parolee.
(g) If the designated Board panel determines that the parolee has failed to comply with the provisions of the parolee contract agreement or the provisions of N.J.S.A. 30:4-123.6 6, the Board panel may terminate the parolee contract agreement and the parolee shall remain on parole supervision until the original parole supervision termination date as established by the Department of Corrections.
(h) Notice of the determination rendered by the designated Board panel pursuant to (g) above shall be provided to the District Parole Office. Upon receipt of the notice, the District Parole Supervisor, designee, or assigned parole officer shall provide a copy of the notice to the parolee.
