Section 10A:72-13.2 - Application procedure; adult parolees
(a) Upon the request of an eligible parolee, the assigned parole officer shall provide the parolee with a copy of the parolee contract agreement form for the parolee to complete.
(b) Upon the eligible parolee submitting a completed parolee contract agreement form and required documentation to the assigned parole officer, the assigned parole officer shall review the parolee contract agreement form within five business days and shall ascertain whether the form is satisfactorily completed and whether the required documentation has been submitted and found acceptable. If the parolee contract agreement form has not been completed satisfactorily and/or the documentation is found to be unacceptable or incomplete, the assigned parole officer shall return the form and documentation to the parolee with specific instructions for the correction of any deficiency.
(c) Upon affirmation that the parolee contract agreement form has been satisfactorily completed and the required documentation found acceptable, the assigned parole officer shall, within five business days, review the parolee's case with the District Parole Supervisor or designee.
1. The District Parole Supervisor or designee shall return the parolee contract agreement form to the assigned parole officer if the form has not been completed satisfactorily or if the required documentation is deemed deficient. The assigned parole officer shall, thereafter, return the form and documentation to the parolee with specific instructions for the correction of any deficiency.
2. Upon affirmation that the parolee contract agreement form has been satisfactorily completed and the required documentation found acceptable, the District Parole Supervisor or designee shall immediately refer the parolee's case to the Supervising Parole Officer for review.
(d) Upon receipt of the parolee contract agreement form and documentation, the Supervising Parole Officer shall, within five business days, review the form and documentation and shall determine whether the form has been satisfactorily completed and the required documentation found acceptable. If the form is determined to be satisfactorily completed and the required documentation found acceptable, the Supervising Parole Officer shall immediately submit the parolee's case to the appropriate Board panel for consideration.
(e) The appropriate Board panel shall evaluate the parolee contract agreement form and documentation within 10 business days of the parolee's case being submitted by the Supervising Parole Officer.
1. If the Board panel elects to approve the parolee contract agreement, the Board panel or Board shall determine the specified reduction to be applied to the parole supervision term upon successful completion of the components of the contract. The Board panel members shall affix their signatures to the parolee contract agreement form and note the date on which the Board panel members executed the form.
2. Upon the parolee contract agreement form being executed, a copy of the form shall be provided to the District Parole Office. Upon receipt of the form by the District Parole Office, the District Parole Supervisor, designee, or assigned parole officer shall provide a copy of the form to the parolee.
3. If the Board panel elects to deny the parolee contract agreement, notice of the determination shall be provided to the District Parole Office. Upon receipt of the notice by the District Parole Office, the District Parole Supervisor, designee, or assigned parole officer shall provide a copy of the notice to the parolee.
4. All original parolee contract agreement forms, supporting documentation, and related documents shall be maintained in the parolee's central office case file maintained by the Board.
