Section 10A:72-12.2 - Travel permit review and issuance; travel outside of the United States of America

(a) A request by an offender to travel outside of the United States of America shall be submitted a minimum of 90 days prior to the proposed departure date unless good cause exists.

(b) Upon receipt of a request by an offender to travel outside of the United States of America, the parole officer shall, within five business days, review the proposed travel request utilizing the criteria specified in 10A:72-12.1(e). The parole officer shall record his or her recommendation as to whether the proposed travel should or should not be approved in the chronological supervision report and forward the travel request and recommendation to an Assistant District Parole Supervisor.

(c) Upon receipt of a request by an offender to travel outside of the United States of America, the Assistant District Parole Supervisor shall, within five business days, review the proposed travel request utilizing the criteria specified in 10A:72-12.1(e). The Assistant District Parole Supervisor shall record his or her recommendation as to whether the proposed travel should or should not be approved in the chronological supervision report and forward the travel request and recommendation to the District Parole Supervisor.

(d) Upon receipt of a request by an offender to travel outside of the United States of America, the District Parole Supervisor shall, within five business days, review the proposed travel request utilizing the criteria specified in 10A:72-12.1(e). Further, the District Parole Supervisor shall take into account that certain countries may have laws that prohibit certain criminal offenders from entry or limit the amount of time that certain offenders may remain in said country. Compliance with such laws must be assured prior to final approval for the requested travel being granted.

(e) Upon the District Parole Supervisor completing his or her review, the District Parole Supervisor shall provide notice to the parole officer and the offender as to whether the requested travel has been approved or denied. If denied, the reasons therefor shall be provided. The District Parole Supervisor shall record the decision in the chronological supervision report.

(f) The District Parole Supervisor shall provide notice to the appropriate Supervising Parole Officer of a decision to deny travel outside of the United States of America.

(g) A Supervising Parole Officer may modify the determination of the District Parole Supervisor to deny the request for travel. If the determination of the District Parole Supervisor is modified, the Supervising Parole Officer shall provide notice in writing of his or her decision and the reasons therefor to the District Parole Supervisor and the assigned parole officer. The Supervising Parole Officer shall record the decision in the chronological supervision report.

(h) The assigned parole officer shall provide the offender with a copy of the decision rendered by the Supervising Parole Officer.

(i) For the purpose of this section, the United States of America shall be considered to be the 50 states, the District of Columbia, and the Commonwealth of Puerto Rico.
