Section 10:75-3.3 - General principles(a) Restraint and seclusion shall be considered emergency safety interventions and shall be used in emergency situations solely to minimize or avoid the likelihood of harm to the residents or staff of the PRTF.(b) Restraint and seclusion shall never be ordered or used as a means of coercion, discipline, retaliation, or for the convenience of staff members.(c) Choice of restraint and seclusion shall be limited to the least restrictive intervention that can be performed safely and is appropriate to the severity if the behavior, and the resident's age, developmental status, size, gender, physical, medical and psychiatric condition and personal history (including any history of physical or sexual abuse).(d) The restraint or seclusion shall terminate once the emergency situation has ended, even if the order for restraint or seclusion has not expired.(e) Restraint and seclusion shall never be ordered or used simultaneously.
