Section Plc 1311.02 - Definitions For purposes of this part, the following definitions shall apply:
(a) "Respondent" means the person against whom a disciplinary sanction is proposed to be imposed; and(b) "Sexual misconduct" means engaging in one or more of the following activities with respect to a current patient who is not a spouse or domestic partner: (1) Engaging in sexual relations, whether consensual or non-consensual;(2) Making verbal or physical sexual advances;(3) Using sexual language or phrases;(4) Requesting sexual favors; or(5) Engaging in physical contact of a sexual nature.N.H.
