Section Pari 811.04 - Greyhound Disposition Form

(a) Whenever a greyhound that has participated in dog racing in New Hampshire is disposed of in New Hampshire, the greyhound's trainer of record, as defined by Pari 801.64 shall, within 30 days of the disposition, execute and file with the commission a greyhound disposition form.

(b) If a greyhound that has participated in dog racing in New Hampshire is disposed of in New Hampshire but has no trainer, the greyhound's kennel operator, as defined by Pari 801.25, shall, within 30 days of the disposition, execute and file with the commission a greyhound disposition form.

(c) If a greyhound that has participated in dog racing in New Hampshire is disposed of in New Hampshire but has no trainer or kennel operator, the greyhound's owner as defined by Pari 801.39, or, if more than one owner, the owner holding the greatest percentage of interest, acting as a representative of all of the owners, shall, within 30 days of the disposition, execute and file with the commission a greyhound disposition form.

(d) If a greyhound that has participated in dog racing in New Hampshire is disposed of in New Hampshire but has no trainer or kennel operator and if no one owner holds the greatest percentage of interest, each of the owners holding the greatest percentage of interest, acting as representatives of all owners, shall, within 30 days of the disposition, execute and file with the commission a greyhound disposition form.

(e) A trainer may forego the execution and filing of the form referred to in (a) above if, and only if, the form is executed by the greyhound's owner or kennel operator and filed with the commission within 30 days of the disposition.

(f) If a greyhound's owner or kennel operator executes and files the form referred to in (a) above within 30 days of the disposition, the owner or kennel operator shall immediately notify the greyhound's trainer, if any, and provide the trainer with a copy of the executed form.

(g) The person executing the greyhound disposition form shall provide the following in the spaces provided:

(1) The registered name of the greyhound disposed of;

(2) The left and right ear tattoo number of the greyhound disposed of;

(3) The name and address of the greyhound's owner at the time of the disposition;

(4) The name and address of the greyhound's trainer at the time of the disposition;

(5) The name and address of the greyhound's kennel operator at the time of the disposition;

(6) The name and address of the race track where the greyhound last raced prior to disposition;

(7) If the greyhound has been transferred to another race track in another jurisdiction, the name and address and of the race track that received the greyhound;

(8) If the greyhound has been retired for breeding, the name and address of the facility that received the greyhound;

(9) If the greyhound has been adopted or placed for adoption, the name, address and telephone number of the person or entity that received the greyhound;

(10) If the greyhound has been euthanized:

a. The name and address of person performing the euthanasia;

b. The professional title of person performing the euthanasia;

c. The professional affiliation of the person performing the euthanasia, consisting of the name of the person's employer, if any;

d. The manner of euthanasia; and

e. A detailed statement of the reason or reasons why the greyhound was not adopted or placed for adoption;

(11) If the greyhound has been sold or donated:

a. The name and address of the individual, corporation or entity that is purchasing or receiving the greyhound; and

b. The purpose for which the greyhound is being purchased or received;

(12) If the disposition of the greyhound did not occur in one of the manners noted in subparagraphs (g) (7) through (11) above:

a. A detailed statement of the specific purpose for which the greyhound has been disposed of; and

b. The destination of the greyhound upon disposition;

(13) The name of the person executing the form;

(14) Whether the person signing the form is the greyhound's:

a. Owner;

b. Trainer; or

c. Kennel operator;

(15) The signature of the person executing the form, certifying the following:

"I declare that, to the best of my knowledge and belief, the information provided on this form is true, correct and complete and acknowledge that knowingly making of a false statement on this form is punishable by law, including by the imposition of those penalties set forth at RSA 284: 14-c, II;" and

(16) The date that the form was signed.

(h) The person signing the greyhound disposition form shall sign the form in the presence of a representative of the commission, which representative shall sign and date the form as a witness to the signature.

(i) For the purposes of subparagraph (h) above relative to the witnessing of signatures on forms, "representative of the commission" means any person, other than the owner, trainer or kennel operator executing the form, who is an employee of the commission.
