Section He-Hea 2202.02 - Market Share Population(a) The applicant shall claim the following market share of its defined primary and secondary service areas as follows:(1) For the primary service area, its projected market share of robotic assisted surgery cases times the population of the primary service area; and(2) For the secondary service area, its projected market share of robotic assisted surgery cases times the population of each town within its secondary service area.(b) Notwithstanding He-Hea 2202.02(a) above, for any robotic assisted surgery system proposed to be located in the service area of existing robotic assisted surgery system services, the applicant shall claim a fractional market share of the primary service area based on total existing and proposed machines.(c) In claiming its market share population the applicant shall include the following data, whenever possible:(1) Out-of-state population and utilization data;(2) Population data bases from bordering states; and(3) Admission patterns of bordering states.N.H.
