Section He-Hea 2202.01 - Service Area(a) Each applicant for a CON for robotic assisted surgery systems and services shall define the proposed primary and secondary service areas for the new or additional systems and services.(b) The primary service area shall include the populations from those towns identified in Table 1003-1 of He-Hea 1003.01.(c) The secondary service area shall include the populations of any additional towns named by the applicant.(d) Notwithstanding (b) above, an applicant shall have the opportunity to demonstrate a service area different from that of Table 1003-1 of He-Hea 1003 by supplying a report in the application that identifies a city or town from which a plurality of patients from the town are discharged.(e) Any applicant that proposes a service area under (d) above shall notify any affected acute care hospital of such proposal.(f) Notification of the proposed service area shall be made in writing with a copy provided to the board as part of the application.(g) In identifying the primary and secondary service areas, the applicant shall include a full description of the proposed service area including the size and demographic characteristics of the service area.N.H.
