Section Fis 812.04 - Unreleasable Wildlife
(a) When it is determined by a consulting veterinarian that, after a period of rehabilitation, the wildlife is unreleasable or incapable of survival in the wild, the executive director shall issue, if requested by the permittee:
(1) A permit to possess individual wildlife, under Fis 804 for the following purposes:
a. For use in cross-fostering or surrogate parenting of orphaned or injured juveniles; or
b. Captive propagation or research as in the restoration and maintenance of threatened or endangered species; or
(2) A permit to exhibit unreleasable wildlife for use in educational displays or programs, which shall be obtained in accordance with Fis 810, provided that the animal in question is capable of feeding itself and adapting to captivity and handling and that the facility can provide long term care and maintenance of the animal.
(b) There shall be no fee for the permit to possess or permit to exhibit wildlife when wildlife remains in the possession of a licensed rehabilitator.
(c) The permit to possess or permit to exhibit shall only be for those individual animals determined to be unreleasable under Fis 812.04.
(d) In addition the permittee shall secure all appropriate USFWS or USDA federal permits to possess or exhibit federally regulated species.
