Section Env-A 622.04 - EPA Review(a) The department shall provide the following to EPA: (1) A copy of the permit application or, upon agreement with EPA, a summary thereof, unless the applicant has filed a copy of the permit application with EPA pursuant to Env-A 609.06(d);(2) A written statement regarding the legal and factual basis for all permit conditions contained in any draft title V operating permit, including references to the applicable statutory or regulatory provisions:(3) After the end of the public comment period specified in Env-A 622.02, a copy of the proposed title V operating permit; and(4) A copy of the final title V operating permit, if issued.(b) Pursuant to 40 CFR §70.8 (c), the EPA shall have 45 days from the date of receipt of a proposed title V operating permit to object, in writing, to the issuance of the proposed permit if EPA determines the proposed permit is not in compliance with applicable requirements of the title V operating permit program or the rules promulgated thereunder.N.H.
