Section Agr 3901.05 - Inspections(a) The department shall conduct farm inspections pursuant to RSA 426-A:4.(b) Initial inspections shall be conducted: (1) On farms whose farming practices include covered activity as defined in 21 C.F.R. Part 112.3, 2016; (2) As the first regulatory inspection activity to evaluate compliance with applicable regulations; (3) With afocus on education unless egregious conditions are observed; and(4) When covered produce is being grown, harvested, packed, or held for distribution.(c) Routine inspections shall be conducted: (1) On farms whose farming practices include covered activity as defined in 21 C.F.R. Part 112.3, 2016;(2) When covered produce is being grown, harvested, packed, and held for distribution; and(3) Once every 3 years on or after the date of initial inspection.(d) Follow-up inspections shall be conducted: (1) To review changes in farming practices, or recordkeeping, on a farm, when noncompliance was noted during a routine inspection; and(2) Within 30 days from the date received, of a written notification to the farm.(e) For-cause inspections shall be conducted in response to a specific issue or produce safety concern, such as an outbreak, reported complaint, or recall.N.H.
