Section 706.398 - Formal written complaints filed by motor carriers or brokers1. The Authority will directly investigate any formal written complaint filed by a motor carrier or broker.2. Such a complaint must be in writing and contain:(a) The name and address of the complainant and, if represented, the name, address and telephone number of his or her attorney or other authorized representative.(b) The name of the motor carrier or broker against which the complaint is made.(c) A complete statement of the grounds for the complaint, including whenever possible, reference to each statute or regulation which is alleged to have been violated.(d) The date of each act or omission complained of.(e) The nature of the relief sought. The formal written complaint must be signed by the complainant or, if represented, by his or her attorney or other authorized representative.
3. Two or more grounds of complaint concerning the same subject may be included in one formal written complaint, but the grounds must be separately stated and numbered. Two or more motor carriers or brokers may join in one formal written complaint if their respective causes of action are against the same respondent and deal with substantially the same alleged violation.4. The complainant shall serve a copy of the formal written complaint on the respondent. Proof of service must be made by affidavit signed by the complainant or, if represented, by his or her attorney or other authorized representative.Nev. Admin. Code § 706.398
