Section 281A.177 - Review panels: Presiding officer; vacancies; tie votes
1. The Chair shall appoint a member of a review panel to serve as the presiding officer of the review panel.
2. Except as otherwise provided in subsection 4, if a single vacancy occurs in the membership of a review panel after the Executive Director has presented his or her written recommendation in a matter to the review panel pursuant to NRS 281A.725 but before the review panel has made a determination, the remaining panel members shall continue to serve on the review panel and act upon any pending issues in the matter before the review panel.
3. Except as otherwise provided in subsection 4, if a vacancy occurs in a majority of the membership of a review panel after the Executive Director has presented his or her written recommendation in a matter to the review panel pursuant to NRS 281A.725 but before the review panel has made a determination, the Chair shall appoint an additional member of the Commission to serve as a member of the review panel to establish a majority of the membership of the review panel.
4. If any review panel vote results in a tie, the Chair shall appoint an additional member of the Commission to serve as a member of the review panel, and the review panel shall reconsider the proposed action.
