Section 474-1-003 - APPEALSEvery recipient or applicant has the right to appeal for a fair hearing in the following circumstances :
(A) The Department has determined the applicant is not eligible to receive program services ;(B) The Department denies a requested service ;(C) The Department determines a recipient's services will be reduced or terminated; or(D) Inaction on an applicant or recipient's request for services . 003.01EXCEPTION. An applicant or recipient is not entitled to a fair hearing when either state or federal law requires automatic case adjustments for classes of individuals unless the reason for an individual appeal is incorrect eligibility determination.474 Neb.
