Section 180-4-038 - PROCEDURES FOR RECEIVING AND OPENING PACKAGESThis section addresses the procedures for opening packages containing radioactive materials.
038.01RECEIPT. Each licensee who expects to receive a package containing quantities of radioactive material in excess of a Type A quantity, as defined in 180 NAC 13-002 and Appendix A of 180 NAC 13, must make arrangements to receive: (A) The package when the carrier offers it for delivery; or(B) Notification of the arrival of the package at the carrier's terminal and to take possession of the package expeditiously.038.02MONITORING. Each licensee must monitor: (A) The external surfaces of a labeled package for radioactive contamination unless the package contains only radioactive material in the form of a gas or in special form as defined in 180 NAC 1-002. A labeled package is a package labeled with a Radioactive White I, Yellow II, or Yellow III label as specified in U.S. Department of Transportation regulations, 49 CFR 172.403 and 172.436-440;(B) The external surfaces of a labeled package for radiation levels unless the package contains quantities of radioactive material that are less than or equal to the Type A quantity, as defined in 180 NAC 13-002 and Appendix A to 180 NAC 13. A labeled package is a package labeled with a Radioactive White I, Yellow II, or Yellow III label as specified in U.S. Department of Transportation regulations, 49 CFR 172.403 and 172.436-440; and(C) All packages known to contain radioactive material for radioactive contamination and radiation levels if there is evidence of degradation of package integrity, such as packages that are crushed, wet, or damaged.038.03MONITORING. The licensee must perform the monitoring required by 180 NAC 4038.02 as soon as practical after receipt of the package, but not later than three hours after the package is received at the licensee's or registrant's facility if it is received during the licensee's or registrant's normal working hours, or not later than three hours from the beginning of the next working day if it is received after working hours.038.04IMMEDIATE NOTIFICATION. The licensee must immediately notify the final delivery carrier and the Department by telephone and telegram, mailgram, or facsimile when: (A) Removable radioactive surface contamination exceeds the limits of 180 NAC 13015.09; or(B) External radiation levels exceed the limits of 180 NAC 13-015.10 and 13-015.11.038.05WRITTEN PROCEDURES. Each licensee must: (A) Establish, maintain, and retain written procedures for safely opening packages in which radioactive material is received; and(B) Ensure that the procedures are followed and that due consideration is given to special instructions for the type of package being opened.038.06EXEMPTION. Licensees transferring special form sources in vehicles owned or operated by the licensee to and from a work site are exempt from the contamination monitoring requirements of 180 NAC 4-038.02, but are not exempt from the monitoring requirement in 180 NAC 4-038.02 for measuring radiation levels that ensures that the source is still properly lodged in its shield.180 Neb.
