Rule 4.12.739 - ENFORCEMENT(1) If, after an inspection, the department determines a violation of these rules may have occurred, then it shall issue a notice of violation to the owner of the anhydrous ammonia facility.(2) The notice of violation shall include: (a) the nature and evidence of the violation;(b) date and place of hearing for review of the violation(s).(3) If, following the hearing, the department determines a violation occurred, then it may certify its findings and conclusions to a prosecuting attorney for prosecution of the violation.NEW, 1986 MAR p. 1820, Eff. 10/31/86.Sec. 80-10-503, MCA; IMP, Sec. 80-10-503, MCA;
