Applications for permits may be approved for construction of frontage roads on the highway right of way, or partly on the highway right of way, where same is made necessary by commercial or residential development of abutting property which, without construction of a frontage road, would adversely affect traffic safety. Such construction will be in accordance with plans and specifications approved by the Department and may be accomplished as agreed upon. If the facility is to be maintained by the applicant, a condition for approval of the permit is the applicant or subsequent property owners as discussed above in Paragraph I(2), maintain the facility as a public road. Where maintenance of the completed facility is to be the responsibility of the Department, the applicant will furnish an appropriate instrument or conveyance on any additional right of way necessary for the maintenance of the completed facility.
