Applications for permits may be approved for construction of frontage roads on the highway right of way, or partly on highway right of way, in instances where the abutting property has not been sufficiently developed to warrant construction of a frontage road at State expense. In these instances, the permit will provide for such construction to be in accordance with plans and specifications approved by the Department, and further provide that the frontage road will be maintained by the applicant. A condition for approval of the permit is the applicant maintains the facility as a public road. In the case that ownership of the property changes from the original applicant, then responsibility for such maintenance carries over to the new property owner.
