Section 3-1-02-202 - Seventy-Two (72) Hour Reporting Requirement1. Compensation shall be denied if the crime was not reported to a law enforcement officer within seventy-two (72) hours after its occurrence, or the victim/claimant must show good cause for failing to report within such time.2. Victim/claimant is considered to have made a report to law enforcement when the victim/claimant has provided a true and accurate report of the incident, which shall include to the best of the victim/claimants knowledge: a. The nature of the crime;b. The location of the crime;c. The name, whereabouts and description of the suspect, if known; and,d. The names of witnesses.3. This requirement is not met if the victim/claimant provides only his/her name and the fact that they were victimized.4. Good cause will be determined on a case-by-case basis. Lack of knowledge about the Division of Victim Compensation is not an example of good cause. Determining good cause for not reporting within seventy-two (72) hours includes, but is not limited to, the following: b. The physical incapacity of a victim/claimant. If the crime was not reported within seventy-two (72) hours, it must have been reported within seventy-two (72) hours after the victim's release from the hospital; and/or,c. The psychological state and any compelling health or safety reasons that would jeopardize the well-being of the victim/claimant.5. The Division of Victim Compensation may waive the seventy-two (72) hour time period required if good cause is shown.3 Miss. Code. R. 1-02-202
