Rule 15-18-77-1.7.3 - Variance Applicant may request the review of a Permit/Recommendation which indicates no Design-based IOWDS can be authorized for installation or if the Applicant disagrees with Permit/Recommendation made by the Department
1. Applicant must write and submit a letter to the Director of Office of Environmental Health requesting a review of the property to determine if the current rules and regulations of the Department have created an unforeseen hardship. The following must be included: a. Name and mailing address b. Telephone number and/or email address c. Copy of the Permit/Recommendation 2. Applicant must write and submit a letter to the Director of the Division of On-site Wastewater requesting a review of the design. The following must be included: a. Name and mailing address b. Telephone number and/or email address c. Copy of the Permit/Recommendation d. Copy of the report from the Licensed Professional Engineer for a proposed IOWDS that will properly treat and maintain wastewater on the property e. Copy of the Licensed Professional Engineer's errors and omissions insurance 15 Miss. Code. R. 18-77-1.7.3
