Rule 15-18-77-1.7.2 - Exemption

Utilization of the exemption by the Applicant, requires the following:

1. Applicant must attest that a single residence will be placed on a single two (2) acre or larger tract of land during the Notice of Intent process and must acknowledge that they have been informed the following entities may require the Department's Final Approval:
a. Board of Supervisor (Ordinance)
b. Water Supplier/Association (Bylaws and/or Water User's Agreement)
c. Lending Institution
d. Utility Authority
e. Others (subdivision covenants, etc)
2. If an additional residence on the same tract is requested to be exempt, the tract must be five (5) acres or larger.
3. Commercial facilities as defined by Rule 3.1.11.1 are not eligible for exemption.
