Section 250-13-2 - Action by the retary of StateThe Secretary of State, having good cause to believe that a person is incompetent or otherwise not qualified to operate a motor vehicle may require that person to submit to a driving evaluation. 29-A M.R.S.A. §1309.
A. Sources of information. Sources of information concerning a person's ability to operate a motor vehicle safely include, but are not limited to:1. Permits, licenses, renewal applications, and accident reports;2. Adverse reports of driving from citizens, family, physicians and other medical personnel, law enforcement and other government agencies.3. Driver history including convictions, adjudications, suspensions, revocations and accidents.B. Driving Evaluation. A person's ability to operate a motor vehicle safely during a road evaluation must be assessed by a driver license examiner. Following completion of the road evaluation, the Secretary of State may: 1. Suspend or revoke the license if the person's continued operation of a motor vehicle presents a potential danger to the person or other persons or property.2. Allow the person to obtain or retain a license.3. Limit or restrict the person's license considering the safety of the public and the person's competence to operate a motor vehicle.29- 250 C.M.R. ch. 13, § 2
