A member or alternate member of the Panel who has a financial interest in a rate determination proceeding brought before the Panel, or in any party to the rate determination proceeding, may not participate in the proceeding affecting that financial interest. Any party to a proceeding may challenge the assignment of any member of the Panel to hear a particular dispute on the grounds of bias or of personal or financial interest, direct or indirect, and may request that the member disqualify himself or herself. Such challenge must be made in good faith and must be made sufficiently in advance of the hearing so as not to result in substantial delay. The member so challenged may consult with private counsel concerning the charge and shall determine the matter as part of the record.
