Rule 11-7.6 - Presiding officer
(1) An administrative law judge shall have the following technical expertise unless waived by the department.
a. A license to practice law in the state of Iowa;
b. Three years' experience as an administrative law judge; and
c. For a hearing related to procurement, knowledge of contract law.
(2) Except as otherwise provided by law, all rulings by an administrative law judge acting as presiding officer are subject to appeal to the department. A party must seek any available intra-agency appeal in order to exhaust adequate administrative remedies.
(3) Unless otherwise provided by law, the director, or the director's designee, when reviewing a proposed decision upon intra-agency appeal, shall have the powers of and shall comply with the provisions of this chapter which apply to presiding officers.
