Section 405 IAC 5-1-4 - Solicitation of services

Sec. 4.

(a) Solicitation, or a fraudulent, misleading, or coercive offer by a provider to provide a service to a member, is prohibited. Examples of solicitation include, but are not limited to, the following:
(1) Door-to-door solicitation.
(2) Screenings of large or entire inpatient populations of long term care facilities, hospitals, institutions for mental diseases, ICFs/IID, or CRFs/DD, except where such screenings are specifically mandated by law.
(3) The use of any advertisement prohibited by federal or state statute or regulation.
(4) Any other type of inducement or solicitation to cause a member to receive a service that the member either does not want or does not need.
(b) Solicitation of early and periodic screening, diagnostic, and treatment services, as specified in 405 IAC 5-15, do not violate the solicitation prohibitions in this section.
