Sec. 9.
(a) A member may present evidence of a good cause exemption at any point to either the office or the member's MCO.(b) A good cause exemption may apply to a member's eligibility in section 2 of this rule, a member's exemption in section 3 of this rule, or a member's qualifying activity in section 4 of this rule.(c) A good cause exemption may be first presented during the member's appeal process as set forth in section 10 of this rule.(d) Recognized good cause exemptions include the following verified circumstances: (1) The member has a disability as defined by the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act, or Section 1557 of the Patient Protection and Affordable Care Act and was unable to meet the requirement for reasons related to that disability.(2) The member is a recent victim, within the previous six (6) months, of domestic violence.(3) Severe inclement weather or other natural disaster.(4) Other circumstances that would impose a severe burden on participating in community engagement activities.
