Section 329 IAC 3.1-1-11 - Notification for existing generators, transporters, and owners or operators of hazardous waste facilities

Sec. 11.

(a) Any person who generates, transports, treats, stores, recovers, or disposes of hazardous waste, as defined in 329 IAC 3.1-6, shall notify the commissioner within ninety (90) days from the effective date of this article, unless such notification has been previously provided to the regional administrator in accordance with 3010 of RCRA ( 42 U.S.C. 6930 ) or in accordance with this article.
(b) Any person who generates, treats, stores, recovers, or disposes of a solid waste which has been determined to be hazardous, or is added to the listing of hazardous waste by any revision of 329 IAC 3.1-6, shall notify the commissioner of such activity, in accordance with section 10 of this rule, this section, and sections 12 through 13 of this rule, no later than ninety (90) days from the effective date of the revision of 329 IAC 3.1-6 which causes the waste to be hazardous or adds the waste to the listing of hazardous waste.
(c) Any person who transports, or offers for transportation, a hazardous waste must first obtain an identification number under section 13 of this rule.
