Sec. 9.
(a) The commissioner or designated representative may inspect any facility regulated under this rule at any time. The storm water pollution prevention plan as required by section 7 of this rule and monitoring records as required by section 7.3 of this rule must be available on-site for review by the commissioner. The department or its designated representatives may make recommendations to the facility owner or its representative to install appropriate measures beyond those specified in the storm water pollution prevention plan to achieve compliance.(b) The department shall investigate potential violations of this rule to determine which person may be responsible for the violation. The department shall, if appropriate, consider public records of ownership and other relevant information, which may include site inspections, storm water pollution prevention plans, notices of intent, contracts, and other information, related to the specific facts and circumstances of the potential violation.(c) Any person causing or contributing to a violation of any provision of this rule shall be subject to enforcement and penalty as set forth under IC 13-14-10, IC 13-15-7, and IC 13-30.
