Section 17-794.1-56 - Projection of employment hours(a) The department may project forward hours of employment for a six-month period. The projection of hours shall be based on current, documented, actual hours of unsubsidized employment (including self-employment), subsidized employment, and on-the-job training programs.(b) Where FTW participants are employed at the time of entry into the FTW program, the FTW staff shall validate employment hours provided for in the current pay stub(s) or employer reports or other suitable documentation and project forward for a maximum of a six-month period.(c) Where FTW participants initiate employment after entry into the FTW program, the FTW staff shall require the participant to complete a two-week period of employment in order to demonstrate work effort. The actual documented hours may be projected forward for a maximum of a six-month period once pay stub(s) or employer records or other suitable documents are available and validated.(d) Where FTW participants submit more than one pay stub, the projection shall be based on the expected future number of employment hours, an average of the pay stubs for fluctuating hours, or will use the pay stub with higher hours to project the employment hours for a maximum of a six-month period.(e) If, at any time during the six-month period, the FTW staff becomes aware of a change in the participant's work situation, the new actual hours must be documented and may be prospectively applied or projected for a new six-month period. (1) If a participant reports a reduction or increase in hours of employment, new documentation shall be required from the client along with a re-determination of the actual average hours of participation.(2) FTW participants that either acquire new employment or lose their current employment shall report the change in employment status within ten calendar days.(f) Where FTW participants are self-employed, the FTW staff shall verify the employment activity through the general excise tax filing or documentation of invoices issued to and payments received from customers and a statement of earnings on a department-prescribed form documenting that participation hours have been met. (1) The actual documented hours may be projected for a maximum of a six-month period once suitable documentation is available and validated.(2) The FTW staff shall calculate the actual hours of participation of a self-employed individual by dividing the individual's net income (gross income minus business expenses) by the federal minimum wage.Haw.
