Section 17-794.1-5 - Work eligible individual (WEI) and other work eligible individual (OWEI)(a) Work eligible individual (WEI) means an adult receiving assistance under TANF, or a non-recipient parent, who is not an NWEI or an OWEI.(b) Other work eligible individual (OWEI) means an adult receiving assistance under TANF, or a non-recipient parent, who is: (1) Unable to engage in substantial gainful employment as defined by the work participation requirements of the Social Security Act, 42 U.S.C. §607, at a job for which he or she is equipped by education, training, or experience, for a period of more than thirty days from the onset of an illness, incapacity, or disability due to a physical or mental impairment or substance abuse, as determined by a licensed physician or psychologist;(2) A domestic violence victim who meets the criteria established in section 17-656.1-20(a) or (b); or(3) Any other adult in an assistance unit that contains a domestic violence victim who meets the criteria established in section 17-656.120(a) or (b).(4) An adult sixty-five years of age or older.(c) All work eligible individuals and other work eligible individuals shall be required to participate in the program to the extent that resources permit.(d) The department shall not be required to provide FTW services to all eligible TANF recipients, if necessary resources are not available.Haw.
