The corporation shall monitor compliance with the terms set forth in the regulatory agreement for the period a project is committed to providing affordable rental units. The corporation will certify the rents being paid by the tenants on no less than an annual basis and recertify the rents being paid by tenants every year thereafter.
Projects shall maintain copies of the rental contracts, rent invoices, or other documents relating to the amount being paid by tenants as rent. Projects will be required to maintain records regarding the number of units (including number of bathrooms and square footage of each bedroom); percentage of rental units that are affordable; rent charged per unit including utility allowances; number of occupants in each unit; and documentation regarding vacancies.
The corporation may perform an audit at least once a year, but shall have access to all books and records upon notice to the project owner. Annually, projects receiving rental housing revolving fund awards shall be required to certify to staff that for the previous year, the minimum set-aside requirement was met; the rent charged to tenants was in accordance with the allowable rental schedule; and each building was suitable for occupancy, taking into account local health, safety and building codes.
