All vessels and all state property or facilities used at a small boat harbor shall be used in such a manner and maintained in such a condition as not to constitute a potential fire hazard. The failure to conform to any statute, rule, standard, or ordinance affecting fire safety may be considered by the department in determining any violation of this section. (Particular attention is directed to the Hawaii state boating law, chapter 200, Hawaii Revised Statutes and the state boating rules, department of land and natural resources, State of Hawaii.
