Section 11-280.1-333 - Variance applications(a) An application for a variance shall be submitted to the department on the "Application for an Underground Storage Tank Variance" form prescribed by the director.(b) A variance fee in accordance with section 11-280.1-335 shall accompany each application for a variance.(c) Every application shall be signed by the owner and operator, and the signature shall be by one of the following: (1) In the case of a corporation, by a principal executive officer of at least the level of vice president, or a duly authorized representative if that representative is responsible for the overall operation of the UST or tank system;(2) In the case of a partnership, by a general partner;(3) In the case of a sole proprietorship, by the proprietor; or(4) In the case of a county, state, or federal entity, by a principal executive officer, ranking elected official, or other duly authorized employee.(d) The director shall approve, approve with conditions, or deny a complete application for a variance or variance renewal or modification as required under this chapter and sections 342L-5 and 342L-6, Hawaii Revised Statutes. The director shall notify the applicant of the director's decision, within one hundred eighty days of receipt of a complete application. Otherwise, a complete application is deemed approved on the one hundred eightieth day after it is received by the department. Haw. Code R. § 11-280.1-333
