Assistance paid to a recipient family shall not include an increase in benefits as a result of the birth of a child during the period in which the family is eligible for TANF assistance or during a temporary period in which the family or recipient is ineligible for TANF assistance pursuant to a sanction for failure to comply with eligibility requirements. This rule shall be implemented as follows:
(a) For families who apply for assistance on or after May 1, 1997, the time limit will be a total of ten months;(b) For families who began receiving assistance prior to May 1, 1997, but who have not received assistance for 24 months, the time limit will be ten months beginning May 1, 1997;(c) For families who have received assistance for 24 or more months after January 1, 1994 and before May 1, 1997, the 24 month time limit will apply. Such families are not eligible for an additional ten months time limit;(d) Family cap provisions do not apply to a child born as a result of a verifiable rape or incest; and(e) If there is a general increase in the amount of TANF assistance provided to all program recipients, families impacted by the family cap are eligible for this increase.Ga.
