Rule 29-5824 - WORK PARTICIPATION REQUIREMENT AND STANDARDS FOR ACCEPTING CLAIMS OF DOMESTIC VIOLENCE
5824.1

In determining whether domestic violence took place, the Director or his or her designee shall rely on the following evidence:

(a) Police, government agency, or court records; documentation from a shelter worker, legal, clerical, medical, or other professionals from whom the applicant or recipient has sought assistance; statements from other individuals with knowledge of the circumstances; physical evidence of domestic violence, or any other evidence supporting the allegations; and
(b) In the absence of evidence in paragraph 5824.1(a) of this subsection, allegations of the victim made under oath, including an applicant's petition for a Civil Protection Order, shall be sufficient to substantiate a claim.
