Rule 10-B2017 - CONDUCT OF HEARINGS
2017.1

The disposition hearing shall be held at the times and places designated by the Board.

2017.2

The hearing may be adjourned from time to time. If the time and place of resumption is publicly announced when the adjournment is ordered, no further notice of the hearing has to be given.

2017.3

A disposition hearing shall be presided over by a presiding officer selected from among themselves by the Board. The presiding officer shall have the authority to do the following:

(a) Regulate the course of the hearing;
(b) Rule on offers of proof and receive relevant evidence;
(c) Assign exhibit numbers for all written documentary and other tangible matter offered in evidence;
(d) Hold conferences for simplification of the issues by consent of the parties;
(e) Dispose of procedural requests or similar matters including motions to amend and to order hearings reopened;
(f) Call, examine, and cross-examine witnesses;
(g) Introduce into the record documentary or other evidence;
(h) Request the parties at any time during the hearing to state their respective positions concerning any issue in the proceeding and theory in support of those positions; and
(i) Take any other action authorized or necessary under §§ 2010 through 2027.
