The applicant or any other person affected or aggrieved by the State Engineer's approval or disapproval of plans and specifications for construction of a reservoir/dam, or the alteration, modification, repair or enlargement of a reservoir or dam which will affect the safety of the structure may request an adjudicatory hearing before the State Engineer pursuant to Rule 10(4)(c) of the Division of Water Resources' Procedural Regulations, 2 CCR 402-5. All adjudicatory hearings will be conducted pursuant to the requirements of the Division of Water Resources' Procedural Regulations and the State Administrative Procedure Act, section 24-4-105, C.R.S.
