Section 59061 - Facility Files

Each facility shall maintain a facility file, available on site, at the facility, which may be stored as electronic records and shall be made available for review, inspection, audit, or copy, upon request. The facility file shall contain at least the following:

(a) Facility program plan;
(b) Weekly staff schedules, including a log of the hours worked by each employee;
(c) Personnel records including:
(1) Administrator current credentials, degrees, and certificates;
(2) Direct care and direct care lead staff current credentials, degrees, and certificates;
(3) Qualified Behavior Modification Professional current credentials, degrees, and certificates;
(4) Documentation of completed staff training including a log of the hours per employee;
(5) Hire, promotion, and separation dates; and
(6) Registered Behavior Technician supervised hours log.
(d) Emergency Intervention Plan;
(e) Certificate of program approval as issued by the Department pursuant to Section 59053(c);
(f) Regional center case management monitoring documentation, such as quarterly case management summary reports;
(g) Regional center facility liaison monitoring;
(h) Regional center Qualified Behavior Modification Professional monitoring;
(i) Behavior and emergency intervention data collection and reporting, including the requirements of Section 4659.2 of the Welfare and Institutions Code;
(j) Findings of immediate danger;
(k) Substantial inadequacies;
(l) Corrective action plans;
(m) Sanctions; and
(n) Facility appeals.

1. New section filed 2-5-2016 as a deemed emergency pursuant to Welfare and Institutions Code section 4684.86; operative 2-5-2016 (Register 2016, No. 6). A Certificate of Compliance must be transmitted to OAL within 24 months. The emergency regulations may be readopted and remain in effect until approval of the Certificate of Compliance.
2. Certificate of Compliance as to 2-5-2016 order, including new article heading and amendment of section, transmitted to OAL 3-27-2017 and filed 5-9-2017; amendments operative 5-9-2017 pursuant to Government Code section 11343.4(b)(3) (Register 2017, No. 19).
3. Renumbering of former article 10 to article 7, renumbering of former section 59061 to 59055 and renumbering and amendment of former section 59070 to section 59061 filed 7-12-2023; operative 7-12-2023 pursuant to Government Code section 11343.4(b)(3) (Register 2023, No. 28).
