Section 345.46 - Database Administration and Security Requirements

(a) Only a primary administrator may establish user accounts.

(b) Prior to accessing the database or assigning user accounts, a court primary administrator, a TVS owner and a TVS operator shall complete, sign and retain with the business records pursuant to Section 345.56 (f) of this Article an Information Security and Disclosure Statement (Firm), form EXEC 201X (Rev. 3/2003), which is hereby incorporated by reference.

(c) A user may enter or retrieve completion information through the database only if all of the following requirements are satisfied:

(1) The user completes, signs and submits to the primary administrator an Information Security and Disclosure Statement Public/Private Partnerships Employee, form EXEC 200X (Rev. 3/2003), which is hereby incorporated by reference, prior to using the database, and annually;

(2) The primary administrator retains all form EXEC 200Xs signed by the user;

(3) The primary administrator enters the user's name and information into the TVS Course Completion Database Access Log, form OL 770 (New 12/2011), which is hereby incorporated by reference, and is maintained by the primary administrator and retained pursuant to section 345.56(h);

(4) The user does not disclose any information processed or handled in the course of entering or retrieving data to any person other than fellow employees who are also authorized users, or as otherwise allowed by this section.

(d) A TVS owner, TVS operator, TVS instructor, TVS primary administrator, or other system user shall not use any information received from a customer, the court, or the department for any purpose other than the purposes authorized by this Article.

(e) The information described in section 345.44(b) is confidential department information obtained by a TVS for the purpose of entering it into the department's database or creating a receipt of enrollment, participation or completion.
