Section 35-9-110 - Investigation of fires; testimony; subpoena; arrest(a) The state fire marshal may take testimony under oath and cause the testimony to be reduced to writing. (b) When the examination discloses that a fire or explosion was of incendiary origin, the state fire marshal may arrest the supposed incendiary or cause him to be arrested and charged with the crime. The state fire marshal shall transmit a copy of the testimony to the district attorney for the county where the fire, explosion or attempt occurred. (c) The state fire marshal may: (i) Subpoena witnesses and compel their attendance before him; (ii) Cause to be produced papers he requires in the examination; and (iii) Administer oaths and affirmations to persons appearing as witnesses before him.
