Section 78B-7-703 - Violation(1) A violation of an ex parte civil stalking injunction or of a civil stalking injunction issued under this part constitutes the criminal offense of stalking under Section 76-5-106.5 and is also a violation of the civil stalking injunction.(2) A violation of an ex parte civil stalking injunction or of a civil stalking injunction issued under this part may be enforced by a civil action initiated by the petitioner, a criminal action initiated by a prosecuting attorney, or both.Renumbered from § 77-3a-103 and amended by Chapter 142, 2020 General Session ,§ 60, eff. 7/1/2020.Enacted by Chapter 276, 2001 General Session.
