Section 76-10-113 - Prohibition on distribution of flavored electronic cigarette products - Prohibition of electronic cigarette products without federal authorization(1) Subject to Subsection (2), it is unlawful for a tobacco retailer that is not a retail tobacco specialty business to give, distribute, sell, offer for sale, or furnish a flavored electronic cigarette product to any person.(2) Notwithstanding Subsection (1), and beginning on January 1, 2025, it is unlawful for a person to give, distribute, sell, offer for sale, or furnish to any person a flavored electronic cigarette product.(3) Beginning on January 1, 2025, it is unlawful for a person to give, distribute, sell, offer for sale, or furnish to any person an electronic cigarette product that is not a premarket authorized or pending electronic cigarette product.(4) An individual who violates this section is guilty of:(a) a class C misdemeanor for the first offense; and(b) a class B misdemeanor for any subsequent offense.Amended by Chapter 470, 2024 General Session ,§ 8, eff. 7/1/2024.Added by Chapter 302, 2020 General Session ,§ 28, eff. 7/1/2020.
