Section 63A-17-1001 - Controlled substances and alcohol use prohibitedExcept as provided in Title 26B, Chapter 4, Part 2, Cannabinoid Research and Medical Cannabis, an employee may not:
(1) manufacture, dispense, possess, use, distribute, or be under the influence of a controlled substance or alcohol during work hours or on state property except where legally permissible;(2) manufacture, dispense, possess, use, or distribute a controlled substance or alcohol if the activity prevents:(a) state agencies from receiving federal grants or performing under federal contracts of $25,000 or more; or(b) the employee to perform his services or work for state government effectively as regulated by the rules of the executive director in accordance with Section 63A-17-1002; or(3) refuse to submit to a drug or alcohol test under Section 63A-17-1004.Amended by Chapter 329, 2023 General Session ,§ 76, eff. 5/3/2023.Renumbered from §67-19-33 and amended by Chapter 344, 2021 General Session ,§ 160, eff. 7/1/2021.Amended by Chapter 1, 2018SP3 General Session ,§ 136, eff. 12/3/2018.Amended by Chapter 139, 2006 General Session.
