Section 31A-2-215 - Consumer education(1) In furtherance of the purposes in Section 31A-1-102, the commissioner may educate consumers about insurance and provide consumer assistance.(2) Consumer education may include: (a) outreach activities; and(b) the production or collection and dissemination of educational materials.(3) Consumer assistance may include: (a) explaining: (i) the terms of a policy;(ii) a policy's complaint, grievance, or adverse benefit determination procedure; and(iii) the fundamentals of self-advocacy; and(b) informal efforts to negotiate a resolution of a dispute between a consumer and a licensee.(4)(a) Notwithstanding Subsection (3) and Section 31A-2-216, consumer assistance may not include: (i) commencing an administrative, judicial, or other proceeding against a licensee to obtain specific relief from the licensee for a specific consumer; or(ii) otherwise representing a consumer in any administrative, judicial, or other proceeding.(5) Nothing in this section prohibits the commissioner from taking enforcement action for violations under Section 31A-2-308.(6) The commissioner may adopt rules necessary to implement the requirements of this section.Amended by Chapter 120, 2024 General Session ,§ 5, eff. 5/1/2024.Amended by Chapter 308, 2002 General Session.
