Section 31A-16-117 - Judicial review - Mandamus(1) A person aggrieved by an act, determination, rule, or order or any other action of the commissioner pursuant to this chapter may seek judicial review in accordance with Title 63G, Chapter 4, Administrative Procedures Act.(2) The filing of an appeal pursuant to this section shall stay the application of any rule, order, or other action of the commissioner to the appealing party unless the court, after giving party notice and an opportunity to be heard, determines that a stay would be detrimental to the interest of policyholders, shareholders, creditors, or the public.(3) A person aggrieved by a failure of the commissioner to act or make a determination required by this chapter may petition the district court in Salt Lake County for writ in the nature of a mandamus or a peremptory mandamus directing the commissioner to act or make a determination.Amended by Chapter 401, 2023 General Session ,§ 46, eff. 7/1/2024.Added by Chapter 244, 2015 General Session ,§ 21, eff. 10/1/2015.
