Section 26B-5-504 - Criteria for essential treatment and interventionA court shall order an individual to undergo essential treatment for a substance use disorder when the court determines by clear and convincing evidence that the individual:
(1) suffers from a substance use disorder;(2) can reasonably benefit from the essential treatment;(3) is unlikely to substantially benefit from a less-restrictive alternative treatment; and(4) presents a serious harm to self or others.Renumbered from § 62A-15-1204 and amended by Chapter 308, 2023 General Session ,§ 100, eff. 5/3/2023.Added by Chapter 408, 2017 General Session ,§ 6, eff. 5/9/2017.
