Section 26B-3-610 - Hospital reimbursement(1) To the extent allowed by law, the department shall in any contract with a Medicaid accountable care organization to implement Medicaid expansion include a requirement that the Medicaid accountable care organization reimburse hospitals in the Medicaid accountable care organization's provider network at no less than the Medicaid fee-for-service rate.(2) Where the department implements Medicaid expansion as a fee-for-service program, the department shall reimburse hospitals at no less than the Medicaid fee-for-service rate.(3) Nothing in this section prohibits the department or a Medicaid accountable care organization from paying a rate that exceeds the Medicaid fee-for-service rate.Amended by Chapter 284, 2024 General Session ,§ 24, eff. 5/1/2024.Renumbered from § 26-36c-208 and amended by Chapter 306, 2023 General Session ,§ 106, eff. 5/3/2023.Amended by Chapter 1, 2019 General Session ,§ 11, eff. 2/11/2019.Added by Chapter 468, 2018 General Session ,§ 25, eff. 5/8/2018.
