Section 37.010 - Advertising(a) The commission may not adopt rules restricting advertising or competitive bidding by a license or registration holder except to prohibit false, misleading, or deceptive practices.(b) In its rules to prohibit false, misleading, or deceptive practices, the commission may not include a rule that restricts:(1) the use of any medium for advertising;(2) the use of a license or registration holder's personal appearance or voice in an advertisement;(3) the use or duration of an advertisement by the license or registration holder; or(4) the license or registration holder's advertisement under a trade name.Added by Acts 2001, 77th Leg., ch. 880, Sec. 1, eff. 9/1/2001.
