Section 22.077 - Certain Activities Near Airport Boundaries Prohibited(a) A joint board for which the constituent agencies are populous home-rule municipalities may not begin construction in a prohibited area of any of the following without receiving the approval of the municipality in which the facility or site is to be located:(1) a sewer and wastewater treatment plant;(2) an aboveground aviation fuel storage facility, not including pipelines for transporting fuel;(3) a sanitary landfill site;(4) a hazardous-waste disposal site; or(5) a facility designed primarily for aircraft engine testing.(b) An area is a prohibited area for the purposes of construction of a facility or site described by Subsections (a)(1)-(4) if:(1) the area is within 1,000 feet of any part of the boundary of the airport as the boundary existed on the date the airport began operations; or(2) after the date the airport began operations the airport boundary is expanded under Section 22.075 to include contiguous property and the area is within 1,000 feet of any part of the boundary of the airport after that expansion.(c) An area is a prohibited area for the purposes of construction of a facility or site described by Subsection (a)(5) if:(1) the area is within 500 feet of any part of the boundary of the airport as the boundary existed on the date the airport began operations; or(2) after the date the airport began operations the airport boundary is expanded under Section 22.075 by more than 500 feet to include contiguous property and the area is within 1,000 feet of any part of the boundary of the airport after that expansion.(d) The construction of a deicing facility by the joint board does not require the approval of the local government in which the facility is to be located.Tex.
